Charities and non-profit entities play an important role in Society.
 
Creation and Registration
There are 3 different ways to create a charity in South Africa: Voluntary Association, Non-Profit Trust or Non Profit Company (NPC)
Dependent on the type of entity it will require a constitution, Trust deed or Memorandum of Incorporation (MOI) which has to comply with the relevant legislation, such as 

• Non Profit Organizations Act
• Income Tax Act
• Trust Administration Act
• Companies Act

Tax
Once the entity is established, to qualify for beneficial tax rules it must also register with SARS as a Public Benefit Organisation (PBO)

Section 18A donations
PBO's who qualify may also register to issue Section 18A certificates, which means the donors may deduct their donations from tax. This is beneficial to attract funding.
The registration process is onerous and continued compliance is required to maintain 18A status.
